  • Ondo Gov Akeredolu returns to Nigeria after 3 month medical vacation

The Governor of Ondo State, Rotimi Akeredoku, returned to the country a few minutes ago.

It was gathered that the airline conveying Governor Akeredolu, who has been on medical vacation in Germany for weeks, touched down at the Nnamdi Azikiwe International Airport Abuja at about 3:20 pm

Akeredolu, it was gathered, was flown in in a private jet with United Aviation flight number N728LB.

A source said although the governor landed in Abuja, he would immediately be flown to Ibadan Airport.

“Immigration officials will only stamp his passport in Abuja since he is just coming into the country.

“He will then be immediately flown to Ibadan Airport, possibly for onward movement, or maybe he will spend the remaining days of his extended medical leave in his Ibadan home.

“This much is clear since he will not be flying to Akure where there is local airport. He will possibly stay in Ibadan,” said another source.

The governor was flown out of the country to Germany on May 31 to get foreign medical attention.

Following rumours of his deteriorating health, pictures and videos of the governor have been circulated on social media to dispel rumours of his death.

While recuperating, he had written to the state House of Assembly to seek an extension of his medical leave.

His deputy, Lucky Ayedatiwa, has been acting in his stead for over three months.

Gabon Coup: Junta Permits Ousted President To Travel For Health Reasons

    Ali Bongo, ousted Gabon president

Ali Bongo, ousted Gabon president, has been granted freedom from house arrest by the military junta in Gabon to depart the nation for medical care.

In a statement signed by General Brice Clotaire Oligui Nguema, military spokesperson Ulrich Manfoumbi stated, “Given his state of health, the former President of the Republic Ali Bongo Ondimba is free to move about.

“He may, if he wishes, travel abroad for medical checkups.”

This was broadcasted on national TV on Wednesday evening.

Bongo, who had been held under house arrest, following a military coup on August 30, was ousted from his position shortly after being declared the victor in heavily disputed elections, which aimed to prolong his 14-year presidency.

While the coup has garnered support from the general population in Gabon, it has faced criticism from the African Union and the global community.

Following his inauguration, Nguema declared that the military had assumed control of the nation peacefully and pledged to facilitate legitimate and fair elections, ultimately restoring authority to the citizens.

According to Al Jazeera, Bongo experienced a stroke half a decade ago and has been unable to consult with his personal medical professionals since then.

  • Akwa Ibom’s Eno Flags Off Palliatives Distribution

Akwa Ibom’s Eno Flags Off Palliatives Distribution

…sues for even distribution to people at grassroots

Akwa Ibom State Governor, Pastor Umo Eno, has flagged off the distribution of Palliatives to cushion the ameliorating effects of fuel subsidy removal on residents of the State with an appeal to the Palliative Committee to ensure distribution of the palliatives comprising forty bags to each of the villages and residents of the State irrespective of party affiliations, gender, tribe and religion.

Speaking at a brief ceremony to flag off the palliative distribution at Government Warehouse, Ikot Ekpene Udo, Nsit Ubium Local Government Area, Governor Eno explained that the State has so far received 2 billion naira out of the 5 billion naira meant to have been released to each State in the country, adding that the money is given as loans to be refunded in parts to the central government and appealed to the Federal government as well as agencies handling the palliatives distribution to release the second tranche of the fund to enable the State governments address the basic needs of the people.

He pointed out that the State government has spent over 5billion naira to support federal government efforts and enumerated part of the expenses as recommended by the Palliative Committee to include 2billion naira for the purchase of a hundred thousand bags of rice, 2 billion naira for payment of gratuities of retirees, 1billion naira for payment of bursary to students, 2 billion cash award to three thousand workers in the State, among others .

“I would like to say that the Federal Government so far has released two billion naira out of the reported five billion for this palliatives. I would like to also inform you that the money naira, some of it comes as a loan to the states. So the states will pay for this two billion naira in some part as a loan.

“We appeal to the Federal Government, the agencies handling these palliatives to please send us the balance of the money so that we can reach our to our people and ensure that our people get what they deserve.

‘I believe that a few people have tried to take advantage of that and they have been telling the youths to ask the Governor where he kept the five billion naira that the federal Government released. Please check your records and be sure. We have received two billion and if you check all of the things that the committee recommended and what we have done, the state Government has spent worth over five billion from our own resources to support what the federal Government has done.

“Right now, the two billion would take fifty thousand bags of rice. We have added two billion to make a hundred thousand bags of rice. We have released gratuity by spending about two billion because we still want to cushion the effect of this palliatives. So we make gratuity a priority so that our retirees can also have something.

“We have released another one billion or close to that to our students for bursaries. My special Assistant on Students affairs is here. He is working with the students and the Commissioner for Education to verify all of the students in public tertiary institutions. Once that verification is done, the accountant General does not need to be directed. The money is there. And as we do verifications, they will pay.

“We will add the cash award that was given to about fifty three thousand workers in this state for three months. If you calculate that, it is another two billion. When you calculate all of these things; the Friday market free ticket, transporter free ticket for the next three months, again you will know that this Government has spent well over five billion to support this palliatives.

“There is a special palliative account that has been created, and that account can be audited at anytime to see what we have done. I have said before that this palliative thing is like blood money. You don’t eat such money. Let it go to where it is meant for. You don’t want to be like the people. It is more blessed to give than to receive.

The State Chief Executive appreciated the Labour Union for their contributions to the Palliative Committee, assuring that his administration will continue to work with the labour unions to meet the yearnings of the workers within the available resources in the State coffers .

He said the palliative distribution will continue till the end of the month with each week designated for distribution from the rice millers directly to different Local Government Areas and thanked the security operatives for being alive to their responsibilities by securing the palliatives and preventing sabotage.

Governor Eno used the occasion to call on the youths to protect the palliatives and ensure that it is delivered to the target people who must be resident of the state including Igbo, Hausa, Yoruba communities as well as to the Service Commanders, assuring that the format will be adopted in the distribution of Christmas package in the next couple of months.

He called on well meaning people of the State to compliment government effort by augmenting the package for the people in their communities and ensure that the palliatives go round the communities.

“We will follow the same formats to distribute Christmas rice to our people so that it will get to the villages.

‘This is just a system we have created. So please, I advise and encourage our young people to protect it, guide it untill it gets to your respective villages.

“When you get home, you are from there. You know those who live in the village. Whether he is from there or not, whether he is PDP or APC, whether Christian, Muslim or traditional worshiper, please don’t discriminate so long as he is in the village.

“This rice is for Akwa Ibom State and the residents of Akwa Ibom State. I want to make that very clear. So I urge all village heads, village youth leaders, women leaders to ensure that these palliatives are distributed peacefully. We have also send allocation to other communities that are here in Akwa Ibom. The Housa Community, Igbo community, Yoruba community, and the Niger Delta community.

“We have also sent these in some small measure to service commanders for their people because they reside and work in Akwa Ibom. We have tried as much as we can to make it go round. So we please request that we should ensure that it goes round no matter how small.

Let it just get to the people. And if you know that God has blessed you, I know some village that have added to what we have sent to their villages.

Governor Eno said his presence in Ikot Ekpene Udo for the flag off excercise was a divine Providence, emphasising that the Warehouse where the palliatives are stored was built by the immediate past administration when the then Governor Emmanuel directed that he sited the warehouse in his village after it was rejected by the people which it was meant for out of ignorance, saying that he needed to discountenance nay sayers who are peddling that he brought the palliative flag off to his village.

Earlier, the Palliative Committee Chairman and Secretary to the State Government, Prince Enobong Uwah, lauded the Governor’s initiatives in augmenting the federal government palliative package and for putting a machinery in place to ensure delivery of the palliatives to the very needy at the grassroots, while also showing care for other various categories of citizens in the state.

According to the SSG, the state warehouse had already in stock 13,000 bags of rice and starting distribution with the 2,560 bags to the 64 villages of Nsit Ubium, 1,960 to the 49 villages of Nsit Ibom, adding that distribution to other LGAs will be made either from the warehouse or Local Government headquarters depending on proximity.

Also, the State Chairman, Nigeria Labour Congress, NLC, Comrade Sunny James commended the governor for his workers’ friendly disposition and for the seamless flag off of the palliatives distribution process, stressing that the workers are happy to identify with him.

He equally appreciated him for the measures put in place for the workers to cushion the effects of the subsidy removal, including the salary award for workers and bursary for students, urging the committee to ensure equal distribution of the palliatives, while charging well meaning stakeholders to support government’s efforts.

The Chairman, Nsit Ubium Local Government Council, Architect Iniobong Orok, in his welcome remarks, described the Palliative measures initiated by Governor Umo Eno as historic, lofty and life-touching, especially in the face of the present difficulty and said Nsit Ubium people were honoured to host the flag-off.

The Village Head of Ikot Ekpene Udo, Eteidung Udo Usoro, acknowledged the giant strides of the governor, saying that he has taken off with a great difference by providing quality leadership within 100days in office.

On his part, the Political Leader Uyo Senatorial District, Sen. Effiong Bob, urged people to tick right for Governor Eno, having performed creditably in 100days and used the occasion to canvass support for his administration to enable him deliver on his mandate.

  • Tinubu celebrates success at tribunal, urges Atiku, Obi to support his govt

Tinubu celebrates success at tribunal, urges Atiku, Obi to support his govt

President Bola Tinubu on Wednesday night expressed happiness on his success at the presidential election tribunal.

A five-member panel of the presidential election court led by Justice Haruna Tsammani had a few minutes ago upheld Tinubu’s election in the February 25 election.

Justice Tsammani, who read the judgement, held that the Peoples Democratic Party (PDP) candidate, Atiku Abubakar, and his Labour Party counterpart, Peter Obi, did not successfully prove the allegations of fraud, non-compliance with the electoral act and others in their petitions challenging the outcome of the election.

The president, who reacted to the ruling in a statement issued by his Special Adviser on Media and Publicity, Ajuri Ngelale, urged his rivals and other Nigerians to join hands with him in the ongoing efforts at rebuilding the country.

He reaffirmed his commitment to the vision of building a unified, peaceful, and prosperous country that would work for all.

The statement read: “The President recognizes the diligence, undaunted thoroughness, and professionalism of the five-member bench led by Justice Haruna Tsammani in interpreting the law.

“The President affirms that his commitment to the rule of law, and the unhindered discharge of duties by the tribunal as witnessed in the panel’s exclusive respect for the merits of the petitions brought forward, further reflects the continuing maturation of Nigeria’s legal system, and the advancement of Africa’s largest democracy at a time when our democratic system of government is under test in other parts of the continent.

“The President believes the presidential candidates and political parties that have lawfully exercised their rights by participating in the 2023 general elections and the judicial process, which followed, have affirmed Nigeria’s democratic credentials.

“The President urges his valiant challengers to inspire their supporters in the trust that the spirit of patriotism will now and forever be elevated above partisan considerations, manifesting into support for our government to improve the livelihood of all Nigerians.”

  • Tribunal Upholds Tinubu’s Election As President, Dismisses APM, Obi, Atiku’s Petitions

Tribunal Upholds Tinubu’s Election As President, Dismisses APM, Obi, Atiku’s Petitions

The Presidential Election Petitions Court delivered a 12-hour marathon judgment on Wednesday, throwing out the petitions of the Allied Peoples Movement (APM); the petitions of the Peoples Democratic Party (PDP) and its flag bearer, Atiku Abubakar; as well as the petitions of Labour Party (LP) and its presidential candidate, Peter Obi.

The Tribunal dismissed the petitions of the three parties challenging the victory of President Bola Tinubu of the All Progressives Congress (APC) in the February 25, 2023 poll.

The five-man panel led by Justice Haruna Tsammani did not only dismiss the consolidated petitions of the PDP, the APM and the LP, the panel also clearly affirmed the victory of Tinubu, a former governor of Lagos State, in the presidential poll.

Justice Tsammani said, “This petition accordingly lacks merit. I affirm the return of Bola Ahmed Tinubu as the duly elected President of the Federal Republic of Nigeria. The parties are to bear their cost.”

After much anticipation, the Tribunal delivered its judgment at the Court of Appeal in Abuja, a proceeding that was televised live from 9am to minutes past 9pm.

Some of the notable persons present at the proceeding crowded by Senior Advocate of Nigeria (SAN) include Vice-President Kashim Shettima of the APC, Chief of Staff Femi Gbajabiamila; and LP’s Julius Abure, among others.

Significantly, Obi and Atiku whom had observed previous proceedings of the Tribunal, were not in court on Wednesday. Tinubu was also not in court as he is away in India for the G-20 summit.

The Tribunal first delivered its verdict on the petitions of the APM, followed by the LP and the PDP.

‘INEC At Liberty To Prescribe Mode Of Results Transmission’

The Tribunal moved to the petitions of the Labour Party and ruled that the LP’s petition of irregularities in the 2023 presidential election was generic.

The court ruled that the Independent National Electoral Commission (INEC) was at liberty to decide the mode of transmission of election results during the presidential election on February 25, 2023.

The panel said according to Sections 52 and 65 of the Electoral Act 2022, INEC was at liberty to prescribe the manner in which election results were transmitted during the poll.

The Tribunal consequently dismissed the petition of the LP and Obi, which argued that the victory of Tinubu be annulled on the basis on the “failure” of the commission’s Results Viewing Portal (IReV) to upload election results electronically in real time.

The Tribunal also dismissed Obi and LP’s petitions on 25 per cent votes of Tinubu in the Federal Capital Territory (FCT), saying that Abuja is like other states.

The court said the Electoral Act 2022 made no provision for electronic transmission of election results.

The five-man panel, said the only technological device that was mandatory for INEC to use for the election is the Bimodal Voter Accreditation System (BVAS).

Still on the issue of non-compliance with the Electoral Act and INEC Regulations and Guidelines, Justice Tsammani said there is nothing in the regulation to show that the BVAS must electronically transmit polling units’ results.

The Tribunal also held that the commission’s Results Viewing Portal (IReV) is not a collation system and the judgment in the case of Oyetola Vs INEC clearly supports this.

“There is no provision for the electronic transmission of election results in the Electoral Act 2022,” says Justice Tsammani. “It is at best optional.”

‘Obi, LP Failed To Prove Tinubu Was Convicted For Money Laundering’

In addition, the Tribunal ruled that the Labour Party Obi failed to prove that Tinubu was convicted for money laundering in the United States.

The panel ruled that no record of criminal arrest or conviction was established against Tinubu by the petitioners – Obi and the LP.

Tinubu had allegedly forfeited $460,000 in the US over three decades ago and the petitioners alleged that he was involved in drug trafficking and money laundering.

However, the Tribunal ruled that no criminal charge was filed against Tinubu in the US and that the APC candidate did not go through a criminal trial in America.

The Tribunal said the petitioners failed to prove that the allegation at the United States District Court, Northern District of Illinois, Eastern Division where the forfeiture occurred was a criminal case.

    Five justices to deliver judgments

Justice Tsammani said the ex-governor of Lagos State was not convicted of any crime or any criminal activity and no sentence of imprisonment or fine was imposed on him.

He said according to Section 137 of the constitution, Tinubu is not disqualified from contesting the presidential poll.

‘Atiku’s dual Citizenship Petition Against Tinubu Struck Out’

Moving on to the PDP and Atiku, the Tribunal struck out the petitioners’ case alleging that Tinubu owns dual citizenship and so should be disqualified from the poll.

The panel also struck out the evidence of some of Atiku’s witnesses on the grounds that that their witness statements on oath were not filed along with his petition.

The court also expunged 37 exhibits tendered by the witnesses from the court’s records.

On the issue of dumping of documents on the court, he held that this would only go to the weight to be attached to such evidence.

On the issue of Tinubu’s conviction and the issue of his dual citizenship, the Tribunal again held like it earlier did that this issues were incompetent and liable to be struck out and same were indeed struck out.

On the inability of the election officers to transmit, of the 27 witnesses called by the petitioner, 10 were polling unit agents who testified as to how the elections were conducted in their different polling unit.

All 10 of the witnesses testified that the voting went well and was peaceful in their different polling units but they all said they could not upload results electronically to the portal of INEC, so they entered the results manually and took same to the ward and or state collation center.

The witnesses were emphatic that voting went well, party agents signed the results but the only difficulty was in uploading the results electronically.

The Tribunal strongly stressed that litigation is fought on pleadings, parties swim or sink on their pleadings.

On the allegations that agents of the respondents disrupted the elections, the petitioners said video recordings will be tendered as proof but this was not done.

Issue two was on the 25 percent in the Federal Capital Territory (FCT) and the court simply adopted its earlier decision on the issue.

Issue three was on the qualification of the Tinubu because of the alleged indictment but the petitioners did not place believable evidence before the court.

Rivers gov’t reveal reason for pulling down DAAR transmitter complex

Rivers State Government says it pulled down DAAR transmitter complex in Port Harcourt because the organisation refused to develop the property after two decades that it was allocated to the company.

Rivers State Commissioner for Works, Dr. George-Kelly D. Alabo, in a statement in Port Harcourt on Wednesday explained that the transmitter complex of DAAR Communications, operators of Africa Independent Television (AIT) and Raypower FM was pulled down because DAAR Communications failed to develop the land more than two decades after allocation by the Rivers State Government.

He furthermore stated that DAAR Communications does not have any document to lay claim to the land, including some of the facilities AIT and Raypower FM had been using.

“Originally the structure they were using and the mast they claimed to own do not belong to them. Ab initio, part of those structures belong to Radio Nigeria, they ceded that place to Rivers State Government.”

“DAAR Communications does not have any document to prove that the land or those facilities belong to them. We are talking of over 400 plots of land here,” he added.

Dr. George-Kelly disclosed that the plots of land have been allocated to Rivers indigenes saying that the state government has started construction of a network of roads and drains on the vast land.

“Now we have fenced out the undeveloped portion of the land, as I speak to you, all of those plots have been allocated to Rivers indigenes for immediate development.

“A network of roads and drains is being done so that it will become a kind of estate for Rivers people. The state government wants that place to be GRA Phase V,” he stated.

The Works Commissioner refuted the insinuation that the action of the state government is connected with the political feud that existed between the former governor of Rivers State, Barr. Nyesom Wike and the late founder of Daar Group, High Chief Raymond Dokpesi.

“That is totally fictitious and irresponsible, maliciously woven to tarnish the image of the immediate past governor of Rivers State.

“The former governor of the state took this decision solely for the interest of Rivers State and not for any political vendetta. The interest of one business man cannot override the interest of millions of Rivers people,” the Commissioner added.

The state government on Monday pulled down the transmitter complex of the broadcast station an action condemned by Nigerians and Broadcasting Organization of Nigeria (BON).

Labour Party disagrees with, rejects Tribunal’s judgement

The Labour Party (LP) has expressed dismay and trepidation over the dismissal of petitions by the five-man panel of the Presidential Election Petition Court (PEPC) led by Justice Haruna Tsammani.

The tribunal had ruled on the petition filed by the party and its Presidential candidate, Peter Obi.

The tribunal had struck out the petition filed against President Bola Tinubu and Vice President Kashim Shettima, declaring it as incompetent.

Reacting, National Publicity Secretary of LP, Obiora Ifoh, said justice was not served and it did not reflect the law and the desire of the people.

“Nigerians were witnesses to the electoral robbery that took place on February 25, 2023, which was globally condemned but the Tribunal in its wisdom refused to accept the obvious.

“What is at stake is democracy and we will not relent until the people will prevail.

We salute the doggedness of our team of lawyers who fearlessly exposed the wrath in our system. We can only weep for democracy in Nigeria but we refuse to give up on Nigeria,” Ifoh said.

He said that details of the party’s position will be presented after consultation with their lawyers after the Certified True Copy of the judgement is made available to the party.

He also urged all lovers of democracy to remain focused and hopeful because a new Nigeria is POssible.

  • PEPT dismisses Peter Obi’s entire petition against Tinubu, commences judgement on Atiku’s

PEPT dismisses Peter Obi’s entire petition against Tinubu, commences judgement on Atiku’s

The Presidential Election Petition Court in Abuja has dismissed the petition filed by Peter Obi of the Labour Party challenging the election of President Bola Tinubu.

Haruna Tsammani, who leads the five-member bench, dismissed the petition for lacking in merit in the hours-long judgement delivered on Wednesday.

The court dismissed the petition after resolving all three grounds on which the case was built against Mr Obi and his party, the Labour Party, and in favour of Mr Tinubu and other respondents to the case.

Mr Tsammani held that the petitioners failed to prove the allegations that Mr Tinubu was not qualified to contest the 25 presidential election.

He ruled that the $460,000 forfeiture order of a US court issued against Mr Tinubu in relation to a drug trafficking case in 1993 did not amount to a criminal conviction that could have possibly led to his disqualification from running for the presidency.

He also held that they failed to prove that the election was marred by corrupt practices such as overvoting, suppression of votes, inflation of votes, wrong computation of votes and allegations of votes.

He also ruled that the argument of Labour Party’s lawyers that Mr Tinubu should not be declared winner of the election because he scored less than 25 per cent votes in the FCT is “fallacious and incredibly ridiculous.”

Mr Tsammani said the first port of call would be to consider the directive of state policy and the preamble of the constitution that provides for the equality of citizens.

The court held that the Supreme Court had previously ruled that FCT should be treated as if it were one of the states of the federation.

It added that if the FCT was to be treated as one of the other states, then “it is not superior or inferior to other states of the federation.”

Mr Obi’s case was the second of the three petitions aimed at the outcome of the 25 February presidential election to be dismissed Wednesday.

The court earlier dismissed the petition by the APM.

It is now reading its judgement on the last petition filed by Atiku Abubakar of the PDP.

Tribunal Dismisses LP’s 25% FCT Votes Claim, Says Abuja Has No Special Status

The Presidential Election Petitions Tribunal (PEPT) led by Justice Haruna Tsammani on Wednesday dismissed the claims of the Labour Party (LP) and its presidential candidate, Peter Obi, that they won 25% of needed votes in the Federal Capital Territory (FCT).

During the 2023 presidential election on February 25, LP and Obi won 25%, by securing about 59 per cent of the votes cast.

Neither President Bola Tinubu of the All Progressives Congress (19 per cent) nor Atiku Abubakar of the Peoples Democratic Party (15 per cent) scored up to 25 per cent of the votes in the Nigerian capital.

Ruling on the petition, the five-man tribunal dismissed the charge saying Abuja is like the other 36 states of the federation.

According to the tribunal, FCT residents have no special privileges as the petitioners claimed.

Election Tribunal Strikes Out APC’s Suit Challenging Obi’s LP Membership

The presidential election petition tribunal has dismissed the petition of the ruling All Progressives Congress (APC) on the eligibility of Peter Obi to contest the 2023 general election.

The APC had challenged Obi’s membership of the Labour Party (LP), declaring it incompetent.

Justice Abba Mohammed, a member of the five-member panel who read the lead judgment, said that membership of a political party is an internal affair.

President Bola Tinubu and Vice-President Kashim Shettima had contended that they had the locus standi to institute the petition on the grounds that Obi only joined the LP few days before the election, instead of the mandatory 30 days.

The court however, held that it is not the prerogative of Tinubu and Shettima to challenge Obi’s candidacy.

“The issue of membership of a political party is an internal party affair,” Mohammed said.

The tribunal also dismissed the objection raised by the respondents contending that Obi and LP failed to join Atiku Abubakar, candidate of the Peoples Democratic Party (PDP), as a respondent in their petition.

The court held that Section 133 of the Electoral Act provides that the loser and winner of an election, as well as the person/body who conducted the election, are to be joined as respondents.

  • Tribunal dismisses Peter Obi’s allegation of 2023 election rigging in favour of Tinubu

Tribunal dismisses Peter Obi’s allegation of 2023 election rigging in favour of Tinubu

The Presidential Election Petition Court, PEPC, sitting in Abuja, has dismissed the allegation by the Labour Party, LP, and its candidate, Mr. Peter Obi, that the 2023 presidential election was rigged in favour of President Bola Tinubu.

The court, in its preliminary ruling that was delivered by Justice Abba Mohammed, held that Obi and the the LP did not by way of credible evidence, establish their allegation that the election that held on February 25 was characterized by manifest corrupt practices.

It held that though the Petitioners alleged that the election was marred by irregularities, they, however, failed to give specific details of where the alleged infractions took place.

The court noted that whereas Obi and the LP, insisted that the election was rigged in 18,088 polling units across the federation, they were unable to state the locations of the said polling units.

It further held that Obi’s allegation that fictitious results were recorded to President Tinubu and the APC, by the Independent National Electoral Commission, INEC, was not proved.

More so, it held that the Petitioners were unable to state the figures they claimed were reduced from election results they garnered in different states of the federation, especially in Ondo, Oyo, Rivers, Yobe, Borno, Tabara, Osun and Lagos state.

It held that the Petitioners equally failed to state the polling units where over-voting occured or the exact figures of unlawful votes that were credited to Tinubu by the INEC .

It stressed that though Obi and LP said they would rely on spreadsheets as well as forensic report and expert analysis of their expert witnesses, they failed to attach the documents to the petition or serve same on the Respondents as required by the law.

The court held that though the petition contained serious allegations that bordered on violence, non-voting, suppression of votes, fictitious entry of election results and corrupt practices, the Petitioners, however, failed to give particulars of specific polling units where the incidences took place.

It held that several portions of the petition that contained the allegations, were “vague, imprecise, nebulous and bereft of particular materials.”

    Therefore, the court, struck out paragraphs 9, 60, 61, 66, 67, 68, 69, 70, 71, 72, 73, 76, 77, 78, 83 and 89 of the petition.

Nevertheless, the court dismissed the contention of the Respondents that Obi was not validly nominated by the LP to contest the presidential election.

It noted that the Respondents had argued that Obi left the Peoples Democratic Party, PDP, on May 24, 2022 and joined the LP on May 27, 2022.

The Respondents argued that as at May 30, 2022, Obi, was not a valid member of the LP and could not have duly participated in its presidential primary election.

They insisted that his name could not have been contained in the membership register of the LP, which ought to be submitted to INEC, 30 days before the primary election held.

However, the court, in its ruling, held that the issue of membership is an internal affair of a political party, which is not justiceable.

It held that only the LP has the prerogative of determining who is its member, adding that the Respondents were bereft of the legal standing to query Obi’s membership of the LP.

Likewise, the court, held that contrary to contention by Tinubu and the APC, the Petitioners, were not under any obligation to join Alhaji Atiku Abubakar who came second in the election or his party, the Peoples Democratic Party, PDP, in the case.

It held that both Atiku and PDP are not statutory Respondents or necessary parties to the petition.
