  • Court postpones Stella Oduah, CCECC trial over alleged N5bn fraud

Court postpones Stella Oduah, CCECC trial over alleged N5bn fraud

The Federal High Court, Abuja, on Tuesday, rescheduled the trial of a former Minister of Aviation, Stella Oduah, a Chinese construction giant, CCECC, and others, on N5 billion fraud charges, a case with a history of protracted delays.

The trial judge, Inyang Ekwo, adjourned the case, which was on number three on the case list, due to the absence of the defendants.

Although counsel for the prosecuting agency, the Economic and Financial Crimes Commission (EFCC), Offem Uket, was in court, the defendants, including Ms Oduah, were not in court.

The News Agency of Nigeria (NAN) recalls that Mr Ekwo had, on 21 July, ordered the EFCC to produce persons behind breaching his privacy through text messages on his phone and another group who petitioned the Chief Justice of Nigeria regarding the ongoing case.

The judge, who had adjourned the matter until today, directed that the anti-corruption agency must produce those persons in court.

“I will give a date for trial and make a consequential order because you have allowed this matter to degenerate this way.

“Do you think you can shield any of these persons who have interfered in these proceedings?” he asked rhetorically.

NAN reports that Ms Oduah, a former senator representing Anambra North Senatorial District at the 9th National Assembly, and others were arraigned on 21 July on 25 counts of money laundering involving his activities as Nigeria’s aviation minister in

She was arraigned alongside CCECC Nigeria Ltd, the Nigerian subsidiary of China Civil Engineering Construction Corporation (CCECC) established by the Chinese government to execute international contracts and economic cooperation.

Also joined in the charge are Gloria Odita, Nwosu Emmanuel Nnamdi and Chukwuma Irene Chinyere.

Others include Global Offshore and Marine Ltd, Tip Top Global Resources Ltd, Crystal Television Ltd and Sobora International Ltd.

They all pleaded not guilty to the counts and were admitted to bail in terms of the administrative bail earlier granted them by the anti-graft agency.

    Delays

The case has suffered protracted delays since it was filed in 2020.

Arraignment of defendants was postponed up to 15 times for various reasons before it finally took place in July.

Part of the reasons for adjournments included difficulties in serving some of the defendants and, at another time, the prying of the Attorney-General of the Federation’s office into the case.

Long adjournments in between hearing dates and an anonymous petition written against the trial judge, Mr Ekwo, had also contributed to the delays the case has suffered.

    Charges

The EFCC, on 17 December 2020, filed 25 counts accusing the defendants of laundering various sums of money totalling about N5,052,415,984 between February and June 2014.

The EFCC accused the defendants of conspiracy to commit money laundering, transferring, taking control and taking possession of proceeds of fraud, aiding and abetting money laundering and opening anonymous bank accounts.

Specifically, the prosecution alleged in two of the 25 counts that Ms Oduah and Ms Odita opened anonymous “Private Banking Nominee” dollar and naira accounts with First Bank, thereby committing an offence contrary to section 11(1) of the Money Laundering (Prohibition) Act 2011 (as amended) and punishable under section 11(4) (a) of the same Act.

Review of the charges showed that CCECC Nigeria Limited allegedly transferred over N2.5 billion into the naira account of a Private Banking Nominee between March 31 and June 6, 2014.

In seven of the counts where CCECC is indicted singly and along with Ms Oduah and Ms Oditah, the company was accused of “conspiring with the women to commit money laundering, and directly transferring to Private Banking Nominee account various sums of money totalling N2,583,385,246 which it reasonably ought to have known forms part of the proceeds of an unlawful activity to wit: fraud…”

The prosecution alleged, for instance, in Count 17, that CCECC Nigeria, “on various dates between March 5, 2014, and May 30, 2014” in Abuja, “directly transferred the sum of N868409,349.00 from your account with Zenith Bank Place to Private Banking Nominee Account 2024414450 domiciled with First Bank Plc, which money you reasonably ought to have known forms part of the proceeds of an unlawful act to wit: fraud…”

  • Historian, Ferdi Anikwe to lead exposé on commemoration of Coal Miners Massacre at 3rd Frontier Discourse Public Lecture and Awards

Historian, Ferdi Anikwe to lead exposé on commemoration of Coal Miners Massacre at 3rd Frontier Discourse Public Lecture and Awards

Pacesetter Frontier Magazine, organisers of the Frontier Discourse Annual Public Lecture Series and Awards have revealed that the third edition of the Public Lecture will feature the commemoration of the 74th anniversary of the massacre of coal miners in Enugu by Dr. Ferdinand Anikwe.

This was disclosed in a terse statement released in Enugu by the Acting Editor in Chief of the magazine, Daberechukwu Egbo.

According to the statement, Egbo said the essence of remembering the sad incident was to educate young Nigerians, who make up a majority of guests at the public lecture and awards, and who may not have known of the occurrence of such incident 74 years ago.

She noted that the incident was one of the precursors to the call for independence in pre-independence Nigeria.

The statement reads “One of the identities of Enugu is the presence of coal reserves which have been mined since the early nineties, the reason Enugu State is called the coal city.

“Enugu has a sculpted image around that most persons do not know the story behind. Filling up this lacuna in history is what we hope to achieve by commemorating the massacre of the coal miners who protested their bad working conditions, demanding a better welfare for workers, a move that eventually led to their deaths.

“The incident happened on November 18, 1949 and incidentally, this year’s lecture is billed for November 18. So, at the board, we decided that it will be worthwhile to call the sacrifices of these heroes to remembrance, which was one of the earliest signals of the quest for self governance and independence from colonialists by Nigerians.

“We will honour their memories by awarding and designating the incident with the ‘Most Significant Event of the Era’ award and a brief discourse on what actually transpired will be handled by renowned Historian and Scholar, Ozo Ferdinand Anikwe, Phd”, Egbo said.

On November 18, 1949, over 21 coal miners were brutally massacred and more than 50 others injured by the British colonialists for daring to protest their poor working and living conditions and racial discrimination.

  • Biden to visit Israel as Gaza humanitarian crisis worsens

Biden to visit Israel as Gaza humanitarian crisis worsens

…U.S. envoy meeting Israelis to hammer out plan to let in aid

…Palestinian Authority accuses Israel of genocide

…Iran’s Khamenei says no one can stop “resistance forces”

…Israel calls hostage video released by Hamas “psychological terror”

U.S. President Joe Biden will make a high stakes visit to Israel on Wednesday to show support for its war on Hamas, after Washington said Prime Minister Benjamin Netanyahu had agreed to let humanitarian aid reach besieged Gazans.

Israel has vowed to annihilate the Hamas movement that controls Gaza after Hamas gunmen killed 1,300 people, mainly civilians, during a rampage through southern Israeli towns on Oct. 7, the deadliest single day in Israel’s 75-year history.

Israel has bombarded the Gaza Strip with air strikes that have killed more than 2,800 Palestinians, a quarter of them children, and driven around half of the 2.3 million Gazans from their homes. It has imposed a total blockade on the enclave, halting food, fuel and medical supplies, which are rapidly running out.

Scores of trucks carrying vital supplies for Gaza headed towards the Rafah crossing in Egypt on Tuesday, the only access point to the enclave outside of Israel’s control, but there was no clear indication that they would be able to enter.

U.S. Secretary of State Antony Blinken announced Biden’s planned visit at the end of hours of talks with Netanyahu, in which he said Netanyahu had agreed to develop a plan to get humanitarian aid to Gaza civilians. He gave no details.

Biden will “hear from Israel what it needs to defend its people,” Blinken said, and also hear how Israel “will conduct its operations in a way that minimizes civilian casualties and enables humanitarian assistance to flow to civilians in Gaza in a way that does not benefit Hamas.”

Washington is also trying to rally Arab states to help head off a wider regional war, after Iran pledged “preemptive action” from the “resistance front” of its allies which include the Hezbollah movement in Lebanon.

After visiting Israel, Biden is expected to travel to Jordan to meet King Abdullah and Egyptian President Abdel Fattah al-Sisi.

He will also meet Mahmoud Abbas, president of the Palestinian Authority, which exerts limited self rule in the Israeli-occupied West Bank but lost control of Gaza to Hamas in 2007.

The PA’s Foreign Ministry on Tuesday accused Israel of genocide and ethnic cleansing in Gaza and condemned the targeting of medical centers, hospitals, journalists and schools in air strikes.

    LIFTING RUBBLE WITH BARE HANDS

In Jabalia, in the northern half of the Gaza Strip that Israel has ordered evacuated, frantic residents were using their bare hands to lift chunks of concrete and metal, crying out when they located bodies from under rubble in a huge, smoking bombing crater. Others ran with stretchers carrying the wounded.

A man emerged from a ruined building holding the limp body of a small boy in his arms, covered in chalky soot.

Residents fleeing the north have crammed into southern areas such as Khan Younis, but have found no respite from bombing there.

Amin Hneideq awoke to a powerful explosion in Khan Younis that sent the window crashing down, lacerating his daughter’s head. The bomb had missed his house but destroyed a home nearby, killing a family from the north that had sought shelter there.

“They brought them from the north just to strike them in the south,” said Hneideq, weeping.

The United Nations agency for Palestinian refugees, UNRWA, said only around 14 percent of Gazans had access to water through a single pipe to Khan Younis that Israel allowed to open for three hours on Monday.

“Concerns over dehydration and waterborne diseases are high given the collapse of water and sanitation services, including today’s shutdown of Gaza’s last functioning seawater desalination plant,” UNRWA said in a statement.

“People will start dying without water.”

Israel says 199 hostages were taken to Gaza during the militants’ raid last week. Hamas released a video overnight of one French-Israeli hostage, Maya Schem, calling on world leaders to help her and other captives get home.

Israel’s military called the video “psychological terror against Israeli citizens”. Schem’s mother told a press conference she was “begging the world to bring my baby back home”.

In addition to trying to get aid through the Rafah crossing, Washington also wants it opened to let out Gazans with foreign passports, including several hundred Palestinian Americans. Some Gazans with dual nationality tried to reach Rafah on Tuesday but said it was impossible because of Israeli air strikes.

Even if the crossing opens, the overwhelming majority of Gazans will not be let out. Egypt has said it would allow medical evacuations but rejects any mass exodus amounting to an unacceptable expulsion of Palestinians from their land.

U.S. officials say Israel is concerned that any aid it lets into Gaza could be used to benefit Hamas, and it is working on a plan to ensure that any deliveries are monitored and controlled. A senior U.S. official said Biden’s newly appointed envoy for humanitarian affairs in the Middle East, David Satterfield, would meet Israelis on Tuesday to start hammering out details.

    CLASHES IN ISRAEL’S NORTH

As Israel plans an expected ground invasion of Gaza to root out Hamas, cross border fighting has also intensified on a second front on Israel’s northern border with Lebanon. Clashes there have been the deadliest since the last full-blown war between Israel and Lebanon’s Hezbollah group displaced a million Lebanese 17 years ago.

The Israeli military said on Tuesday it had killed four people who had tried to cross the border to plant explosives. Israel ordered the evacuation on Monday of 28 of its villages in a 2-km-deep (1.2-mile) zone near the Lebanese border.

Iran, which sponsors both Hamas and Hezbollah, has celebrated the Hamas attacks on Israel but denies being behind them. Iranian Foreign Minister Hossein Amirabdollahian told state TV that “preemptive action” would be taken against Israel in the coming hours.

“All options are open and we cannot be indifferent to the war crimes committed against the people of Gaza,” Amirabdollahian said. “The resistance front is capable of waging a long-term war with the enemy.”

Supreme Leader Ali Khamenei told a group of students: “No one can confront Muslims and the resistance forces if the Zionist regime’s crimes against Palestinians continue.”

Netanyahu told parliament on Monday he had “a message for Iran and Hezbollah: don’t test us in the north. Don’t make the same mistake you once made. Because today the price you will pay will be much heavier.”

  • Zulum Gives Brothels 12-hour Quit Notice In Borno, Revokes Land Abandoned By NRC

Zulum Gives Brothels 12-hour Quit Notice In Borno, Revokes Land Abandoned By NRC

Borno State governor, Babagana Zulum, has given a 12-hour quit notice to brothels and criminal dens notorious for prostitution, gangsterism and other illicit activities in Maiduguri, the state capital.

Zulum gave the directive during a visit to ‘Bayan Quarters’, a settlement around Railway Staff Quarters, which harbours the brothels and criminals in Maiduguri.

According to a statement issued on Tuesday, “the area harbours gangsters, criminal activities and minors for commercial sex activities.”

The governor expressed concern over the rise in criminal activities associated with the illegal brothels and criminal dens in the area, including prostitution, drug peddling, and other illicit activities.

He noted that the activities not only posed a threat to the security of the state but also perpetuate social vices that undermine the well-being of communities and the dignity of the individuals involved.

Zulum explained that while the settlement, which harbours the criminals and underaged girls for commercial sex activities will be demolished in 72 hours, the illegal brothels, however, have 12 hours to vacate the place.

“The government has been duly informed of the activities that are going on here, this settlement is completely illegal. People are killed here, this place serves as a breeding space for insurgents. Therefore, I have directed that everybody should vacate the place,” Zulum said.

Zulum also announced the revocation of the land title where such criminal activities were perpetrated, which he said was initially approved for use by the Nigerian Railway Corporation (NRC).

“I understand that this land was approved by Borno State Government to be used by the Nigerian Railway Corporation (NRC), but unfortunately, it’s been rented out illegally with all forms of criminal activities taking place. For this reason, the government has revoked the earlier approval and henceforth, the land belongs to Borno State Government,” Zulum stated.

  • At FEC meeting, FG Proposes N26.01trn 2024 Budget

At FEC meeting, FG Proposes N26.01trn 2024 Budget

The Federal Executive Council (FEC) on Monday proposed N26.01 trillion for the 2024 fiscal year for submission to the National Assembly.

This is according to the Minister of Budget and Planning Atiku Bagudu who spoke after the Council meeting presided over by President Bola Tinubu.

According to him, FEC pegged the price of crude oil at $73.96, exchange rate of $700, and oil production of 1.78 million barrels per day.

“The assumptions include the oil price benchmark, which I said for 2024, we are assuming $73.96, oil production of 1.7 8 million barrels a day at the exchange rate of $700.

“Then the inflation of 21 percent and GDP growth rate of 3.76 percent. The aggregate expenditure is estimated at N26.01 trillion for the 2024 budget which includes statutory transfers of N1.3 trillion, nondebt recurrent expenditure of N10.26 trillion, debt service estimated at N8.25 trillion as well as N7.78 trillion being provided for personnel and pension cost.

“Debt service increased because N22.7 trillion ways and means was securitised meaning it became a Federal Government debt at nine percent.

“So that is easily about 2.1 trillion Naira. This describes that equally personnel cost went up because of transfers under the agreement with labour.”

During the briefing at the Council Chamber, Presidential Villa, Abuja, Bagudu said the government is working to ensure a January-December budget circle.

He said the executive will put efforts in place to ensure the 2024 budget is passed and signed before December 2024. Bagudu also noted that FEC approved the 2024-2026 Medium Term Expenditure Framework (MTEF) and Fiscal Strategy Papers (FSP).

Gaza-Egypt border crossing set to reopen as Israeli troops prepare ground assault

…Israel says no ceasefire agreed in southern Gaza

…Gaza endures another night of heavy Israeli bombing

Israel said on Monday no ceasefire had been implemented in southern Gaza even though security sources in Egypt said a deal had been reached to allow foreigners out of the besieged Palestinian enclave and aid to be brought in.

The bombardment of Hamas-ruled Gaza continued overnight, with residents saying it was the heaviest pounding yet in nine days of conflict.

As a humanitarian crisis gripped Gaza, two Egyptian security sources said Israel had agreed to a halt its bombardment of southern Gaza. The Egyptian-controlled Rafah border crossing was expected to reopen to allow foreign passport holders to leave, they said.

But Israeli Prime Minister Benjamin Netanyahu’s office said in a statement: “There is currently no truce and humanitarian aid in Gaza in exchange for getting foreigners out.”

The situation at the Rafah crossing remained unclear.

The Israeli military and the U.S. embassy in Israel had no comment, while officials from Hamas, which has fired rockets at Israel since its assault on civilians there just over a week ago, did not confirm any ceasefire.

Diplomatic efforts have been intensifying to get aid into the enclave, which has been under intense Israeli bombing since the Oct. 7 attack on Israel by Hamas militants that killed 1,300 people.

Israel has also imposed a strict blockade and is preparing a ground invasion to destroy Hamas.

Authorities in Gaza said at least 2,750 people had so far been killed by the Israeli strikes, a quarter of them children, and nearly 10,000 wounded. Another 1,000 people were missing and believed to be under rubble.

Hundreds of tons of aid from several countries have been held up in Egypt for days pending a deal for its safe delivery to Gaza and the evacuation of some foreign passport holders through the Rafah crossing.

The United States has told its citizens in Gaza to get close to the crossing so they can move out. The U.S. government estimates the number of dual-citizen Palestinian-Americans in Gaza at 500 to 600 among the enclave’s population of 2.3 million, and Washington hopes to get many of its nationals out of harm’s way.

  • President Tinubu to convene FEC meeting today

President Tinubu to convene FEC meeting today

President Bola Ahmed Tinubu will today preside over the second Federal Executive Council (FEC) meeting at the Presidential Villa, Abuja.

Presidential spokesman, Chief Ajuri Ngelale, confirmed this to journalists on Sunday night.

President Tinubu had on August 21, sworn in and inaugurated 45 ministers who attended the maiden cabinet meeting at the Council Chamber of the Presidential Villa in Abuja on August 28.

The three ministers recently confirmed by the Senate – Balarabe Abbas Lawal (Kaduna), Jamila Bio Ibrahim (Kwara) and Ayodele Olawande (Ondo) – are expected to join the meeting today, taking number of ministers to 48.

Daily Trust learnt that the meeting to be convened around 12pm would among issues discuss those approvals the president already granted some ministries.

Also expected at the FEC meeting are the Secretary to the Government of the Federation (SGF); the National Security Adviser; the Head of the Civil Service of the Federation; the Chief of Staff to the President, all the ministers; and some other executive principal officers.

Vice President Kashim Shettima will, however, not be sitting in today’s meeting, having left Abuja for China yesterday to represent the president at the 3rd Belt and Road Initiative (BRI).

Daily Trust gathered that the government had settled for Monday for FEC meetings, a clear departure from what was obtained under the previous administrations.

Regular FEC meetings during the former President Muhammadu Buhari were held weekly on Wednesdays.

It was further learnt that FEC might not be weekly to enable the ministers time to deliver on the assignments before them.

When contacted last week, the Senior Special Assistant to the President on Print Media, Abdulaziz Abdulaziz, said President Tinubu had a different idea of the functions of the Federal Executive Council.

The presidential aide, who said the ministers had been working and consulting with the president, explained that the meeting would be held but it would not follow the usual traditional way of coming every week to announce contract awards.

Mrs Chukwudozie commended the governor’s plan to identify areas and sectors of comparative advantage and to harness and optimize the natural resources in the state for the benefit of the people.

“Your whole initiatives are tailored towards industrialization.
We are happy that we have a governor who is thinking of the industry and how to support us”, she said.

The MAN zonal chairman said the association was established 52 years ago to be the focal point of communication and consultation with manufacturers, to support the ease of doing business, promote industrialization and made in Nigeria products, and deepen their relationship with international and national economic actors in government.

“We would want to be carried along in all that you do because we are more like your own taste buds where you check out your policies for the industry and get feedbacks and suggestions on policies that suit us better”, she stated.

She urged the governor to look into the challenges of manufacturers on the ease of doing business, the ease of registration of businesses and obtaining permits, including Certificate of Occupancy, adding that the government’s new
e-ticketing scheme should be streamlined to reduce levies and avoid multiple taxation.

She also suggested the incorporation of innovation hubs and science-tech parks in the free trade and special economic zones planned by the state government, saying skills can be acquired while creating opportunities for apprenticeship development to help start-ups and support the value chains in the areas of the economy the state is interested in developing.

She extended an invitation to the governor as a guest speaker on manufacturing at the association’s annual general meeting in December.

Responding, Governor Mbah expressed appreciation to MAN for acknowledging his background as a businessman and investor, stressing that nobody will feel the pain of setting up a business more than himself.

“As a private sector person, I recognised that most of my time was spent dealing with external factors, external issues. And I had always said to myself that if I ever had the opportunity to govern, I am going to ensure that we make life easy for business and private sector people.

“When we expressed our vision for the people or Enugu State, something that stood out was the fact that our strategy was going to be completely different from what had obtained in the past. We proposed to grow the economy from the current level of $4.4b to $30b and a lot of that growth is going to come from private sector”, he said

He promised that his administration was going to exceed the expectations of manufacturers and the private sector investors in the areas of the ease of doing, the ease of setting up businesses,
registration of properties and obtaining construction permits.

“We already have a one-stop shop here in Enugu where you are able to obtain all your business registration documents and construction permits; and we have the relevant state and federal agencies housed in that location.

“We are just in the process of making sure that within the next few weeks, you are able to apply and obtain your Certificate of Occupancy within 72 hours. And across all our MDAs, we are raising the service levels. We are moving all our manual processes to digital platforms so you are able to sit in the comfort of your home and obtain government services; making your payments through your digital platforms without going to ask anyone for receipts as you will get your receipts”, the governor assured.

He said as part of creating the enabling environment for business to thrive, government recently awarded contracts for the reconstruction and expansion 71 urban roads, a new dual carriageway to the North Central market, including infrastructure for the New Enugu City sitting on 10,000 hectares of land.
