    JUST IN: Appeal Court Upholds Adeleke As Osun Governor

    The Court of Appeal sitting in Abuja has set aside the decision of the Osun State Governorship Tribunal and has upheld the election of Senator Ademola Adeleke as the governor of the state.

    Following the governorship polls in the state, an Election Petition Tribunal had sacked Adeleke from office, saying that the Peoples Democratic Party (PDP) candidate did not score majority of lawful votes during the July 16 governorship polls.

    However, in a unanimous agreement by a three-man panel led by Justice Mohammed Shuaibu, the Court of Appeal quashed the tribunal’s judgement and gave its verdict to uphold Adeleke as rightful governor of Osun State.

    The Appeal Court Panel revoked the tribunal’s order which directed that a Certificate of Return be withdrawn from Adeleke and issued to his predecessor and All Progressives Congress (APC) candidate, Gboyega Oyetola.

    The panel held that the Osun State Tribunal was wrong to have said that there was over voting, a claim that only relied on the evidence by Oyetola and the APC, and as such, doesn’t prove their case in any way.

    The judge faulted Oyetola and APC, that they only relied on the data from the back end server and failed to look at the voters register which forms the foundation of the whole electoral process and as such, cannot strengthen their allegations of over voting.

    On the issue of jurisdiction, the court resolved in favour of Adeleke stating that section 285(8) of the constitution.as amended, the court has every right to entertain the appeal.

    …vows to “exhaust every action required to ensure the legitimacy of the next government in the state”

    The Enugu State All Progressives Grand Alliance, APGA, governorship flag-bearer, Mr. Frank Nweke Jr, has condemned the alleged irregularities which he said characterized and marred the March 18 Enugu State governorship election.

    In a press conference held at the party’s office, Friday, March 24, 2023, the former Information Minister decried the level of “violence, thuggery, intimidation, use of divisive sentiments, and the weaponization of poverty”, which he alleged were deployed by both the ruling Peoples Democratic Party, PDP and the Labour Party, LP.

    Stressing that he had promised during his campaigns, to congratulate any candidate that emerged in a fair and transparent manner, Nweke said the election was far from fair and certainly, not transparent.

    The statement reads in part:

    “The elections have come and gone, and with it a multitude of infringements on our democratic process, an assault on our desires and our hope for our great state. I celebrate everyone who came out to participate in the democratic process in spite of the challenges, threats and intimidation reported across the State. Your determination is a sign of the awakening that has taken place; and I encourage you to keep your hope alive. Do not despair and do not be discouraged by the unfortunate challenges that have beset our current democratic experience.

    “I often said during my campaign that I would offer my congratulations and best wishes to whoever emerged in a fair and transparent manner. This election was far from fair and certainly, not transparent.

    “The violence, thuggery, intimidation, use of divisive sentiments, and the weaponization of poverty against our people, which the Peoples Democratic Party deployed in the course of the campaign and the elections reflect the desperation of the Party to hold on to power against the will of the people. It was never about service or the good of ndi Enugu; and the impunity with which these wicked acts were carried out is sickening.

    “Just before midnight on Friday, March 17, 2023, another piece of propaganda was released and distributed aggressively to insinuate that I had stepped down for Peter Mbah, the candidate of the People’s Democratic Party. This recurrent lie may be referred to as a “political strategy” but we must call a lie what it is – the absence of integrity, a quality most desired in our government today. We would also discover in the course of the day that agents and canvassers at polling units told voters the same story that I had stepped down on the morning of the election.

    “The House of Assembly candidate of the All Progressives Grand Alliance for Udenu Constituency was attacked and almost killed on the morning of the election, while five polling units within his jurisdiction were cordoned off by police and military officers.

    “In Nsukka, voters recorded and reported gunshots at polling units allegedly instigated by the Labour Party.

    “The most vulnerable and impoverished became prey to vote buying by the People’s Democratic Party and the Labour Party with as little as N500 or packets of noodles in some places. At Udenu, both parties competed for the votes of our people with N2,000, a plate of Jollof rice, Okpa, and a bottle of soda. I feel ashamed that this is what our people are worth to some who seek to lead them. I am even more embarrassed by the so-called enlightened citizens who have lost sight of the implications of these actions.

    “The PDP also secured the assistance of the INEC agents to rig the election, offering cash or issuing threats as the situation demanded.

    “Only a few polling unit agents uploaded their results directly on IREV as provided by INEC, and fake result sheets were used to rewrite and manipulate the results of vote counts at the polling units before the falsified results of the elections were uploaded to the IREV. Some of these result sheets are also completely blurred on the portal.

    “The collation centres at the local government headquarters were completely hijacked by thugs and compromised security operatives, and party agents other than the agents of the PDP were not allowed access to any stage of the collation process until Sunday morning. At 7:20 pm on election day, shots were fired sporadically at the Nkanu West collation centre in Agbani, while the military stood aside and watched. Similar breaches of the law and subversion of the electoral process occurred across many locations in the State.

    “At the start of this campaign, I said emphatically that no ambition is worth the life of any individual. My sentiments about this have not changed. It is unfortunate that those who seek to govern our state are comfortable with expending the lives of citizens as political collateral damage.

    “The elections of March 18, 2023 in Enugu State were a complete sham. They were not fair. They were not free. And they were not credible.

    “Yet, none of these actions came as a surprise. Weeks before the election, and consistently, we shared detailed intelligence reports of the impending disaster with the Independent National Electoral Commission and the security agencies. We consistently received assurances and chose to believe that our democracy would be protected in the face of the desperate plans for subterfuge.

    “It is unfortunate that resolute actions were not taken to avert the threats we reported. Again, we saw that the problem is not democracy itself. The problem is the people and institutions that we rely upon to manage our democracy.

    “The entire process, down to the declaration of its winner is a complete farce and will lack legitimacy for as long as it stands.

    “The results of Nkanu East local government area which were contested, got reviewed and revised by the national office of INEC without any basis given for the change in numbers. If it was a case of over-voting, the expectation is that the result from the local government area should have been cancelled.

    “It does seem that the numbers were simply manufactured to fit a preprogrammed outcome and read out to the public, as can be inferred from the Returning Officer of INEC in the state, Prof Maduebibisi Ofo Iwe’s comments about acting under authority and reading out what he had been given.

    “I am utterly disappointed with the manner in which the Independent National Electoral Commission handled the 2023 elections. I am also saddened by the actions of some members of our security agencies. Both of these institutions of State let the people down when they became compromised by a few desperate power mongers and looters. The unchecked intimidation and violence, the massive rewriting of results and the overall abuse of the people’s will would have failed if not done in connivance with the electoral umpire and members of our security agencies.

    “I have no problem losing an election to the will of the people. But when this will has been subverted, we have no choice but to review the entire process and the outcome.

    “We will explore and exhaust every action required to ensure the legitimacy of the next government in Enugu State. You cannot hold accountable something that was acquired by illegitimate means.”

    Asked why his party agent signed the result at the state collation centre if he (Frank Nweke Jr) didn’t accept the outcome of the election, he noted that the agent acted on reasons best known to him (the agent).

    “Well, whoever signed the results, his reasons are best known to him, but the elections for the reasons I have described, was a complete farce, a complete sham”.

    Asked if would challenge the outcome in court, he responded: “With the level of disenfranchisement, insecurity, conflict situation, voting buying that was recorded, I will exhaust every opportunity to hold INEC and other accomplices accountable for the conduct of this election.”

    On whether he would remain in APGA and build the party or dump the party since he didn’t realize his mandate, he said: “I hold the mandate of the party. I am the flag bearer of APGA here in Enugu. It’s a mandate I respect and honour and we would pursue every opportunity available for us to obtain results.”

    Recall that Frank Nweke Jr emerged in the third place with the total valid votes of 17,983 in the keenly contested election.

    President Buhari assents to Copyright Act bill, others

    President Muhammadu Buhari has assented to two Bills recently passed by the National Assembly.

    The bills are the Copyright Act 2022 and the Federal College of Medical Laboratory Science and Technology, Jos, Act.

    Senior Special Assistant to the President on National Assembly Matters (House of Representatives), Nasiru Baballe Ila, disclosed this in a statement and explained that the two bills were assented to by the President on the 17th of March 2023.

    He said: “Copyright Act 2022, this Act repeals the Copyright Act, Cap C28, Laws of the Federation of Nigeria, 2004 and enact the Copyright Act 2022 to provide for the regulation, protection and administration of copyright.

    “The enactment the new Copyright Act has again demonstrated the commitment of this administration to re-energizing Nigeria’s creative economy and making it more globally competitive in the digital and age.

    “The principal objectives of the new law, as outlined in section 1 are to: protect the rights of authors and ensure just rewards and recognition for their intellectual efforts; provide appropriate limitations and exceptions to guarantee access to creative works; facilitate Nigeria’s compliance with obligations arising from relevant international copyright treaties and conventions; and enhance the capacity of the Nigerian Copyright Commission for effective regulation, administration, and enforcement.”

    According to him, the new Copyright Act “expands the rights of authors, raises the sanctions for criminal infringements and more adequately addresses the challenges posed by digital and online use of copyright works.

    “The Act also provides specially for the needs blind, visually impaired and print disabled persons to have access to learning and reading materials in accessible formats.”

    He further observed that the ‘Federal College of Medical Laboratory Science and Technology, Jos, Act, repeals the Federal School of Medical Laboratory Science, Jos (Establishment) Act, 2018 and enacts the Federal College of Medical Laboratory Science and Technology, Jos Act, 2023.

    To this end, the newly signed Act “establishes the Federal College of Medical Laboratory Science, Jos, to make the Institution more effective in the discharge of its functions by strengthening the organisational framework, and to bring its provision in conformity with current democratic principles and operations of existing educational institutions, and the laws of the Federal Republic of Nigeria,” Hon. Ila noted.

  • UK Court Finds Ekweremadu, Wife, Doctor, Guilty Of Organ Trafficking

    A former Deputy Senate President, Ike Ekweremadu; his wife Beatrice and their doctor have been convicted of organ trafficking, in the first verdict of its kind under the Modern Slavery Act.

    Ekweremadu, 60; his wife, Beatrice, 56; and Dr Obinna Obeta, 51, were found guilty of facilitating the travel of a young man to Britain with a view to his exploitation after a six-week trial at the Old Bailey.

    They criminally conspired to bring the 21-year-old Lagos street trader to London to exploit him for his kidney, the jury found, according to UK Guardian.

    The prosecutor Hugh Davies KC told the court the Ekweremadus and Obeta had treated the man and other potential donors as “disposable assets – spare parts for reward”. He said they entered an “emotionally cold commercial transaction” with the man.

    The behaviour of Ekweremadu, a successful lawyer and founder of an anti-poverty charity who helped draw up Nigeria’s laws against organ trafficking, showed “entitlement, dishonesty and hypocrisy”, Davies told the jury.

    He said Ekweremadu, who owns several properties and had a staff of 80, “agreed to reward someone for a kidney for his daughter – somebody in circumstances of poverty and from whom he distanced himself and made no inquiries, and with whom, for his own political protection, he wanted no direct contact”.

    Davies added, “What he agreed to do was not simply expedient in the clinical interests of his daughter, Sonia, it was exploitation, it was criminal. It is no defence to say he acted out of love for his daughter. Her clinical needs cannot come at the expense of the exploitation of somebody in poverty.”

    Ekweremadu, who denied the charge, told the court he was the victim of a scam. Obeta, who also denied the charge, claimed the man was not offered a reward for his kidney and was acting altruistically. Beatrice denied any knowledge of the alleged conspiracy. Sonia did not give evidence.

    The race to the Lion Building, Enugu State’s seat of power, has come to an end following the declaration of Dr. Peter Ndubuisi Mbah of the Peoples Democratic Party, PDP,  as the winner of the tightly contested 2023 Enugu State Governorship Election by the Independent National Electoral Commission.

    Mbah scored a total of 160,895 valid votes to defeat his closest contender and Labour Party candidate, Barr. Chijioke Edeoga, who scored 157,552 valid votes.

    The announcement was made by INEC after the resumption of the collation center this night.

    Press Release: Resumption Of Collation Of Governorship Election Results In Abia And Enugu States

    It will be recalled that the Commission met on Monday 20th March 2023 and reviewed the conduct of the Governorship and State Assembly elections held nationwide on Saturday 18th March 2023.

    Arising from the meeting, the Commission took the decision to suspend further collation of the Governorship election results in some parts of Abia and Enugu States in order to carry out a review of the collation processes in both States.

    The Commission has concluded the review. Consequently, the collation of

    results for the Governorship election in both Abia and Enugu States will continue today 22nd March 2023.

    The Commission appreciates the patience and understanding of the people of both states as we conclude the collation processes.

    President Buhari expresses eagerness to hand over

    “I am eager to go,” Buhari said at the State House in Abuja Tuesday while receiving the outgoing United States Ambassador, Mary Beth Leonard.

    He said given the chance of a free and fair election as well as non-interference as was witnessed in the February 25 and March 18 elections, Nigerians had proved to be capable of deciding who led them without anyone telling them what to do.

    He expressed satisfaction with the remarkable passion towards democracy exhibited by Nigerians through the choices they made in the 2023 general elections.

    The president, according to a statement by his spokesman, Garba Shehu, said Nigeria’s democracy had truly matured.

    He said: “People are realising their power. Given the chance of a free and fair vote, nobody can tell them what to do. I am unhappy that some candidates lost in the election.

    “But I am inspired by the fact that voters were able to make their own decision, to decide who won and who lost. With the currency change, there was no money to spread around but even then, I told voters to take the money and vote according to their consciences.”

    He said he was completely satisfied with his own role in the election process staying above it, without meddlesomeness or any form of interference.

    He expressed hope that Nigeria would continue to make progress in building a nation out of our different and competitive communities.

    The president said he enjoyed working with Leonard and wished that she had more time to serve here.

    Earlier, Leonard had listed fuel subsidy removal among critical decisions Buhari could take before leaving office on May 29.

    She said she was happy with the progress made in Nigeria-US relations in the three-and-half years, specifically citing the recent institution of a five-year visa regime between the two countries; active collaboration in security and the supply of military hardware including warplanes and the soon-to-come fighter helicopters; and also cooperation in the health sector to fight HIV and COVID response, giving assurances that US will continue to assist in the strengthening of Nigeria’s health sector.

    She expressed her gratitude and that of the US government in the continuing role of the President in ensuring regional security and strengthening of democracy as a system of government, citing his strong response against the recent surge of coups-d’état in West Africa as worthy of commendation.

    Enugu residents and supporters of the Peoples Democratic Party, PDP, have, once more, called on the Independent National Electoral Commission, INEC, to, without further delay, announce its candidate, Dr. Peter Mbah, the winner of the Saturday March 18 governorship election in Enugu State.

    The winner of the Enugu governorship polls is yet to be announced following controversies over the results from Nkanu East and Nsukka Local Government Areas.

    PDP supporters have been holding protests at the INEC Enugu headquarters demanding that their candidate be declared winner.

    Addressing journalists on Tuesday, a former member, House of Representatives, USA Igwesi, said the people were running out of patience.

    Igwesi said collation of the governorship election results had been completed, adding that INEC had no other thing to do than declare Mbah winner.

    “This is the second day of our protest, that INEC should declare Peter Mbah as the winner of the March 18, 2023 gubernatorial election in Enugu State, having polled majority of the lawful votes cast” he stated.

    Igwesi said collation of the governorship election results had been completed, adding that INEC had nothing else to do than declare Mbah winner.

    “We went to the polls on the said day, and with the results collated, we needed to necromancer or a soothsayer to tell us that Peter Mbah won that election.

    “We are perplexed; we are surprised that INEC is still holding this result undeclared and we are aware of the Electoral Act, Section 64, Sub Section 8 that says that once the State Returning Officer collates the result, he doesn’t have to waste a minute in announcing and declaring that result. That is why we are surprised that up till this movement, INEC has refused to declare Peter Mbah as the winner of the election.

    “We are also aware of the provisions of Section 103, Sub Section 1 of the same Electoral Act that said that if you are aggrieved, if you have petitions, you should go to the Election Petitions Tribunal. INEC does not usurp the power of the Election Petition Tribunal.

    “INEC can only receive and collate results, which they have done in this instance; they don’t have power to look at the result; they should not look at petitions; I was a member of 5th National Assembly that helped in authoring this particular Electoral Act”, Igweshi added.

    While further faulting the electoral commission, Igwesi noted, “I am saying that what transpired during the Collation of Presidential Election result on 25th February, should equally be applicable to Enugu State.

    “On that occasion, Dino Melaye and other PDP agents, even agents of other political parties, raised an alarm that there were discrepancies, there were over-voting in the whole states of the Federation and that INEC should not go ahead with the collation of that result.

    “We are begging them to come and declare Peter Mbah the winner of the election and as long as they keep holding this result, we will keep occupying Enugu”, he concluded.

    Presidential Poll: Obi, Other Candidates File Petitions To Challenge Tinubu’s Victory

    The Labour Party (LP) and its candidate, Mr Peter Obi, have formally filed a petition at the Election Petition Tribunal in Abuja, challenging the declaration of Bola Tinubu of the All Progressives Congress (APC), as the winner of the February 25, 2023, presidential election.

    The petition marked: CA/PEPC/03/2023, has the Independent National Electoral Commission (INEC); Tinubu; his running mate, Senator Kashim Shettima, and the APC as the 1st to 4th respondents.

    The petitioners are praying for the tribunal to declare that Tinubu was not duly elected by a majority of the lawful votes cast at the election. They want an order mandating INEC to retrieve the certificate of return issued to the APC candidate and issue a fresh one to Obi.

    The petitioners specifically alleged that at the time of the election, Tinubu was not qualified to contest.

    They also argued that the election was invalid by reason of corrupt practices and non-compliance with the provisions of the Electoral Act 2022.

    Obi prayed the tribunal to make an order cancelling the election and compelling INEC to conduct a fresh election in which Tinubu, Shettima, and the APC will not participate.

    Similarly, the Action Alliance and the Allied Peoples Movement have equally lodged separate petitions to challenge the outcome of the presidential election.

    While the petition by Action Alliance and its presidential candidate, Solomon Okanigbuan, was marked: CA/PEPC/01/2023, that of the Allied Peoples’ Movement, was marked: CA/PEPC/04/2023.

    The candidate of the Peoples Democratic Party, Atiku Abubakar, is expected to file his own petition before midnight when the deadline will elapse.

    Enugu Guber Result: INEC lacks powers to suspend collated results – PDP

    The Campaign Council of the Enugu State chapter of the Peoples Democratic Party (PDP) has disagreed with the Independent National Electoral Commission (INEC) on its decision to suspend the announcement of the final results and declaration of Dr. Peter Mbah as the winner of the Enugu State governorship contest, stressing that the election management body was overreaching itself, as it could not, by law, suspend the declaration of an already collated result.

    The PDP equally also said INEC was wrong to present the Abia and Enugu cases as the same.

    The party stated these at a press conference addressed by the spokesperson of the Enugu State PDP Campaign Council in Enugu on Monday.

    The PDP said: “Putting the Abia and Enugu situations in one basket clearly shows that the national headquarters of INEC is mixing things up or has not been properly briefed. There is absolutely nothing like outstanding local governments as far as the collation process in Enugu State is concerned.

    “Unlike the situation in Abia State, the results of the entire 17 LGAs of Enugu State, including those of Nkanu East and Nsukka LGAs, have been fully collated by the Returning Officer, Prof Maduebibisi Ofo Iwe, on Sunday the 19th of March. What remains for the INEC is to sum up the returns by the Local Government Returning Officers and declare our candidate, Dr. Mbah the governor-elect.

    “That is why we are saying that INEC is overreaching itself; they have no powers at this stage to suspend the pronouncement or declaration of the winner of the election, which is our candidate.

    “Section 64(8) of the Electoral Act 2022 provides that where collation has been completed as in the present case of Enugu State, the duty of the collation officer, who collated the result is to announce the result and make a declaration. Therefore, having collated the results from Nsukka LGA and Nkanu East LGA, the statutory duty and legal responsibility of the State Returning Officer is simply to announce and declare the results, as INEC cannot, by law, suspend the declaration of result already collated”.

    On issues relating to accreditation and votes cast in a polling unit and the fate of such votes where they exceed the number of accredited voters in such units, the PDP said such are guided by Section 51(2) of the Act.

    “The position of the law is that a Returning Officer has no power to cancel any results at the stage of collation. The only option open to any person dissatisfied with the process is to resort to Section 130(1) of the Electoral Act, which vests the power to receive and adjudicate petitions complaining of an undue election or undue return in an election in the tribunal or court.

    “As a matter of fact, we are dissatisfied with the result from Nsukka Local Government Area. We are dissatisfied with the results from Udenu, Isi-Uzo, Ezeagu, and more. But is not for us to take the laws into our hands or indulge in self-help. That is why we are ready to go and interrogate those results at the appropriate quarters because we can no longer complain as the collation has been completed.

    “INEC cannot choose the ones you will collate to release the result and the ones you will collate and withhold the result”, the PDP emphasised.

    “We believe that the Returning Officer for Nkanu East Local Government Area has duly complied with the provision of Sections 64(4)(a)&(b) and Section 64(a)&(d) of the Electoral Act 2022.

    ”We consequently restate our position that the only option left to INEC acting through the State Returning Officer for the Enugu State Governorship Election under Section 64(8) of the Electoral Act 2022 is to announce the results and make a declaration of the winner of the election.

    “We therefore call on INEC to immediately announce the summation of the 17 local governments it has already collated and declare Dr. Peter Ndubisi Mbah the winner of the March election”, the PDP reiterated.

    The PDP also expressed worries that the INEC was already overheating the Enugu polity by the needless delay in the pronouncement of the winner of the governorship election.

    “We will continue to caution that INEC should not take the patience of the electorate and people of Enugu for granted. We know what it took us today to rein in their voluminous anger as it relates to the delay in the declaration of Dr. Peter Ndubuisi Mbah as governor-elect and we are calling on the INEC to cease forthwith this foot-dragging and declare our candidate the duly elected candidate in the last election” the PDP stressed.

    The party also condemned what it described as desperate and hypocritical approach of the Labour Party to the elections.

    “In the instance, our Enugu East senatorial candidate lost his election to return to the Senate to the Labour Party. It was the same process that produced the result that gave Labour Party the victory that also produced the winner of the governorship election in the Nkanu East in the same senatorial zone. But while the Labour Party has accepted the result for the Senate, they are contesting the governorship that the same process produced. This is hypocrisy”, the party concluded.
