  • Evans: Absence of defence counsel stalls his re-arraignment for murder

Evans: Absence of defence counsel stalls his re-arraignment for murder

The scheduled arraignment of convicted kidnap kingpin, Chukwudumeme Onwuamadike popularly known as Evans, failed to go on Thursday at the Lagos High Court sitting in Ikeja, owing to the absence of his counsel.

Trial judge, Justice Adenike Coker subsequently adjourned till June 13 for the planned arraignment.

Evans and his co-defendant, Joseph Emeka are facing an amended 5-count charge of murder, attempt to kidnap and conspiracy.

They allegedly killed one Peter Nweke on Aug 27, 2013, along Third Avenue, Festac Town, Lagos State.

The duo were also alleged to have killed one Chijioke Ngozi, and attempted to murder and eventually killed the Chairman of the Young Shall Grow Motors, Obianado Vincent.

When the matter came up before Justice Coker on Thursday, the defendants were called into the dock.

However, when the judge asked why they were not represented by a counsel, both men told the court that they were not aware of the arraignment, and expressed doubts as to whether their lawyers were aware.

A Lagos state government counsel, Yusuf Sule who announced their appearance for the prosecution, however, told the court that the counsel representing Evans, who was the first defendant, was aware, and even though he was based in Abuja, Sule told the court that he communicated with him earlier in the morning.

The prosecutor also told the court that counsel to the second defendant was before her brother’s judge in another court.

He informed the court that the two defendants had applied for a plea bargain, which was still being considered by the Attorney General of the state.

Sule also drew the court’s attention to the amended 5-count charge as two previous defendants, Chiemeka Arinze, and Udeme Frank, were no longer captured in the new charge. He explained that one of them had passed on in prison while the other had been convicted.

The prosecutor asked the court to grant a new date for the arraignment of the defendants on the amended charge.

Counsel for the second defendant, Nelson Onyejiaka who had come in then announced his appearance, and confirmed that plea bargain talks were indeed ongoing.

Justice Coker noted that with the absence of Evans’s counsel, the proceedings could not go on.

She then directed Evans to make sure his counsel was present on the next adjourned date, and subsequently fixed June 13 for arraignment and a report on the plea bargain agreement.

Leave Town Now, Enugu CP Issues Immediate Quit Order to Remnant Criminal Elements as He Storms Uzo Uwani LGA

The Enugu State Commissioner of Police, CP Kanayo Uzuegbu has issued an immediate quit order to remnant criminal elements in the state, saying they either leave town or meet their Waterloo.

CP Uzuegbu stressed that there would be no relenting in the effort to totally flush them out of the state.

He stated this on Monday when he led a team of battle tested police operatives to Adani in Uzo-Uwani LGA where two brothers, Mr. Ogbonna Fidelis Anene, aged 33, and Ogbonna John Onyeka, aged 25, were gruesomely murdered on their way going from the farm on Sunday.

CP Kanayo, while expressing sadness over the ugly incident, assured the people of Adani that a crack squad had been sent after the perpetrators to bring them under the full weight of the law, while also reinforcing security in the border local government area.

He commended Governor Peter Mbah for his determination to rid the state of all criminal elements, noting that the governor’s support and investment in security was responsible for the state’s status as one of the safest federating units in the country.

The CP asked the natives to go about their lawful businesses, assuring of the resolve and cooperation of the security agencies to secure them both at home and in their farmlands.

He, however, appealed to the people to be vigilant and assist security agents with relevant information of any suspicious persons or criminal activities in their environment.

“The Enugu State under the watchful eyes of the administration of Peter Mbah and the Nigeria Police can never allow the perpetrators of this evil act to go scot free. The government is displeased with this ugly report and we shall ensure justice for the Ogbonna brothers. That is the governor’s demand and that is the Inspector General of Police’s order.

“You can’t stop going to farm because it is your means of livelihood, but we are guaranteeing your safety. We shall clamp down on these criminals. Enugu is already too hot for them, but we shall make it even hotter for them going forward. So, I urge you all to take heart and count on us for your ceaseless protections,” the CP said.

Meanwhile, the Town Union President General, Emmanuel Utazi, who spoke on behalf of the people, in company of Hon. Matthew Idu and Barr. Vincent Diugwu expressed delight over the visit of the Commissioner and his team, stating that Adani remained very peaceful people, who relate with everyone and had never had any crisis with any community to warrant such murders.

While commending Governor Mbah for the drastic drop in violent crimes in the state he, however, urged the administration to pay extra attention to Uzo Uwani, being a vast border LGA made up of sprawling farmlands.

“We are happy the Commissioner of Police is here in person to console us. We shall do exactly as you have said and shall continue our farming activities because we are counting on your assured safety and our governor’s assurances,” said PG Utazi.

  • Usifo Ataga: Police Officer Says Chidinma Admitted Spiking Deceased’s Drink

Usifo Ataga: Police Officer Says Chidinma Admitted Spiking Deceased’s Drink

The trial of an undergraduate student, Chidinma Ojukwu for the murder of the Chief Executive Officer of Super TV, Usifo Ataga resumed today at the Lagos High Court sitting at the Tafawa Balewa Square on Lagos Island with the testimony of a Deputy Superintendent of Police (DSP), Olusegun Bamidele.

He told Justice Yetunde Adesanya, that Chidinma the murder suspect, told him she spiked the drink of the deceased and that he believed her.

Ojukwu, a 300-level, Mass Communication student of the University of Lagos (Unilag), is facing trial for the offence alongside her sister, Chioma Egbuchu and one Adedapo Quadri.

Bamidele who is serving with the homicide department of the State Criminal Investigating Department (SCID) Yaba, was answering questions about the incident while being cross-examined by the defence counsel, Mr. Onwuka Egwu.

At the resumption of the cross-examination, a video displaying the last moments of the deceased, Ataga and the suspect, Chidinma was played to ascertain the items in the video as listed in the evidence given to the court as exhibits.

Egwu asked the witness to confirm that the items were handed over to him in the state they were seen in the video.

“The belt and the sneaker were put together in a nylon bag while the key was used in removing the car from the compound to Maroko police station. There was no blood stains on them.

“In your record of August 20, 2021, you reported finding a blood-stained t-shirt, confirm that the blood-stained t-shirt was not tendered here”, Egwu said.

“The t-shirt counsel is referring to wasn’t brought here to the court because the Deoxyribonucleic acid (DNA) people took it for analysis”, answered the officer.

“So this t-shirt has not been tendered”? the counsel asked.

“It’s not in this court, it’s at the DNA office, the witness answered.

“So you can’t confirm the DNA of the blood on that t-shirt?, asked Egwu.

    “I cannot confirm”. Bamidele replied.

“Can you confirm that the nylon she entered the place with is conspicuously on the table”.

    Yes, replied Bamidele

“Did you find out what was in that bag? “
    asked Egwu.

“The essence of the video was to establish that the defendant and the deceased were there, so I didn’t look into the nylon. She denied knowing the deceased at first instance. I didn’t get to know what was in the bag”, said Bamidele.

The witness was also questioned on the electronic gadgets recovered.

“Did She tell you the MacBook was a gift?” the lawyer asked.

“She told me before she left the apartment, she took along the deceased two phones and a MacBook”, the witness answered.

“Did she in any of her statements say that the MacBook was a gift and the iPhone was hers?”

“None of the properties belong to her. She told me one on one. Interaction and written statement are two different things.”

Counsel to the second defendant, Babatunde Busari also cross-examined the witness.

He asked the witness if there was any document to show that all the items recovered from the apartment of the first defendant, Adedapo Quadri, were forged.

The items include bank statements, Unilag school ID card, driver’s license, an International passport and the ID card of one Mary Johnson.

“I did not investigate whether it was forged or not, none of the documents were found in the custody of the first defendant, replied the police officer.

Bamidele also stated that it was based on the suspicion of the timeline of the telephone conversation between the first and second defendant that he requested the call log from the telephone network but he did not tender the transcript of the call log.

When asked about the drug Rophybol, the witness testified that the first defendant, Chidinma told him that a dose of the drug is capable of knocking a person out. He also said that he tendered a sample of the drug in evidence.

“Do you have any training in narcotics or pharmaceutical speciality? Are you aware of the National Drug Law Enforcement Agency (NDLEA), the counsel asked.

    “Yes”.

Do you have a report from the NDLEA on the Rophynol tendered before this court?

    “No”.

You believed that the first defendant must have spiked the drink of the deceased? asked Busari.

“It’s not like I believe, based on my interaction with her, she told me what she did and I believed her”, said the witness.

Justice Adesanya has adjourned till January 29 for the continuation of the trial.

  • Police Says Nurse’s Injections Caused Chain Reaction Leading To Mohbad’s Death

Police Says Nurse’s Injections Caused Chain Reaction Leading To Mohbad’s Death

The Lagos State Police Command says there are indications that the injections an auxiliary nurse identified as Ms Feyisayo Ogedengbe administered to the late Mohbad caused a chain of reactions that led to the Afrobeats singer’s death.

Mohbad, whose real name is Ilerioluwa Aloba, died on September 12 at the age of 27. His death has since become a subject of controversy as old videos of the Afrobeats singer alleging bullying and physical assault resurfaced.

The Commissioner of Police, Idowu Owohunwa, who spoke on Friday at a press briefing to share findings of police investigations, said Ogedengbe who was contacted and invited by Ayobami Sadiq aka Spending, a friend of Mohbad, on September 11 to treat the singer in his Lekki home.

“She eventually came on Tuesday, 12 September, 2023, and administered three different injections, which are believed to have occasioned the chain of reactions that directly resulted in the eventual death of the singer,” Owohunwa said.

“She is the principal suspect in the death of Mohbad. She acknowledged that it was the injections she administered on the deceased that triggered the reactions which eventually led to Mohbad’s death.”

Other expert opinions and witnesses’ statements corroborated her admittance, the police commissioner added.

“Her action of administering doses of tetanus toxoid, paracetamol (intravenous), and Cetrazone injection, which was also administered intravenously to Mohbad at his residence on 12 September, 2023, immediately triggered the reactions, including vomiting, goose bumps and convulsion that eventually resulted in the singer’s death,” Owohunwa said.

“This criminal liability is further heightened, granted the evidential fact that as an auxiliary nurse, she is not qualified to administer such medications or function as a qualified nurse. She also did this in a non-clinical environment and in a professionally negligent manner that negated standard medical protocols.”

In addition to Sadiq, three other suspects were named, including Ibrahim Oluwatosin Owodunni aka Primeboy; Samson Balogun aka Sam Larry; and Abdul-Aziz Fashola aka Naira Marley.
